Decision of Supreme Court : LGED takes initiative to include master rolls employees in revenue sector

The Local Government Engineering Department (LGED) has taken initiatives to include the second, third and fourth class employees working in various development projects and master rolls in the revenue sector.

According to the judgment of the High Court and the Appellate Division of Supreme Court , they are being appointed permanantly.

Earlier also 3092 people have been regularized in various posts from last 28/09/2011 to 2/03/2020. As there were no vacancies at that time, the remaining 3441 adjudicated employees could not be regularized.

At present, if 1460 posts in various categories are vacant, according to the instructions of the Local Government Department, in accordance with the judgment of the Appellate Division Appeal No. 460/2017 dated 2nd July 2019, the said 1460 vacant posts and the remaining 1931 posts are subject to regularization of the said 3391 persons who have been adjudicated in the case. Department has been requested.

It may be noted that the judgment of Appellate Division Appeal No.-460/2017 does not create any obstacle to the proposed regularization. As the proceedings of the regularization cases were settled by the Appellate Division before the judgment of that 460/2017 case.

Moreover, when the opinion of the Law Ministry was sought on whether the 460/2017 case will create any obstacle for the Directorate of Cooperatives under the same Ministry to regularize the convicts in similar cases, the Ministry of Law said that since the cases related to regularization were decided by the Appellate Division before the judgment of the 460/2017 case was published, 460/ 2017 case judgment will not be applicable to regularization.

It should be noted here that partial regularization of the adjudicated employees in the regularization case and non-regularization of the rest amounts to discrimination in the implementation of the judgment in this regard, which is also a violation of the constitutional fundamental rights.

It is also to be noted here that implementation of this recruitment will not create seniority related complications as there are clear rules regarding determination of seniority of regularized employees.
