A teacher of Mass Communication and Journalism department at Begum Rokeya University, Rangpur served a legal notice to the university authorities on Thursday seeking seniority and appointment as Head of the Department as per a High Court verdict of 2017.

Anichur Rahman, Advocate of Supreme Court of Bangladesh, served the notice on behalf of the petitioner Md. Md. Mahamudul Haque, an Assistant Professor of the department, who joined as a faculty of the department following the High Court verdict.

The notice has been served to the vice-chancellor, registrar, the committee relating to appoint Head of the Department and members of the Planning Committee under the Department.

The notice says: “The sender (Mahamudul Haque) is the senior most qualified teacher to be appointed as Head of the Department under the existing rules, customs and procedure of the University. His seniority has been determined in a sterling –landmark judgment passed in Writ Petition No. 11758 of 2013.

The recommendation as to the appointment of the notice sender as teacher by the selection Board dated 13.01.2013 was approved by the 21th and 22th syndicate meeting of the University. The Hon’ble High Court Division directed the Vice-chancellor and the registrar to comply with the said recommendation.

The direction given by the HCD (High Court Division) was affirmed by the Hon’ble Appellate Division of the Supreme Court of Bangladesh. The notice sender had filed a Contempt petition as the University authority has refrained from implementing the direction given by the HCD.”

It also says: the University authorities remained nonchalant to implement the direction of the High Court Division, Mahamudul Haque filed another writ plea (No. 2768 0f 2022) with the High Court. Later the HC issued a Rule on 14 March 2022 calling upon the university authorities to show cause as to why they should not be directed to provide seniority and other service benefits of the petitioner as per the judgment of High Court passed in Writ Petition No.11758 of 2013 and as to why they should not be directed to take appropriate legal action against Tabiur Rahman Prodhan for tampering in the recommendation sheet of the appointment.

The notice receivers have been requested to take needful-legal steps to appoint Mahamudul Haque Head of the Department as senior most teacher within seven days otherwise the Mahamudul Haque will move before the High Court.
