Gopalganj Municipality has allegedly been failing to take effective action against the owner who built building on other people's land in violation of municipal laws.

Md. Dalim Khan, son of Nazrul Islam Khan, owner of holding no. 96 in the teacher palli area of Sard N. 10 of Gopalganj Municipality, illegally occupied several areas of the house of Adv. Nur Hossain Dulal (holding no. 99) and built a building, but the Gopalganj Municipality has complained that the accused Md. Dalim Mia did not take any action against him for unknown reasons.

In this regard, the victim Adv. Nur Hossain Dulal told the media, "I am a lawyer and live in Dhaka for professional reasons." The owner of the house next to my place, Md. Dalim Khan, violated the provisions of Sub-section No. 4 (d) of Section 18 (eighteen) published on July 18, 1996, which was later published and the provisions of Sub-section B (5) of Section 21 (twenty-one) of 2020, despite the clear provision to build a house with a distance of 6 feet 7 inches from the rear boundary. I filed a written complaint with the Mayor of Gopalganj Municipality on 22/05/2023.

Later, the municipal authorities visited the spot several times and investigated the matter and found the primary truth of the allegations made against the accused Md. Dalim Khan. In view of the clear violation of Section 35.36 of the Second Schedule of the Local Government (Municipality) Act 2009 and not working as per the plan approved by the Municipality, the Municipal Authority issued the first notice vide Memorandum No. 2022 -- 2023/527/4(3) dated 06/06/2023 and the second notice vide Memorandum No. 2022 -2023/126/4(4) dated 14/09/2023 to remove the said illegal establishment.

A copy of Memorandum No. 2022 -- 2023/126/4(4) signed by the Mayor of Gopalganj Municipality on 14/09/2023 has also been given to me as the Deputy Commissioner of Gopalganj, District Superintendent of Police, Municipal Councilor of Ward No. 10 and the complainant.

Despite receiving notices twice from the Gopalganj Municipality, the accused Md. Dalim Khan built a house on my land without demolishing the illegal structure, showing the thumbs up to the municipal law. But unfortunately, the accused Md. Dalim Khan continued the construction of the building by disobeying the municipal order in this regard. Later, when the Gopalganj Municipal Authority did not take any legal action against the accused Md. Dalim Khan, I was helpless and filed a writ in the High Court against the concerned parties (Writ No. - 10389/2023.).The High Court Division issued a 4-week rule after hearing the writ.

In this regard, the victim Adv. Nur Hossain Dulal further said that the accused Md. Dalim Khan has caused me immense damage socially, mentally and financially. I strongly demand that the illegally constructed part be removed quickly through a fair investigation and the culprit be brought to justice.
