High Court order to recover temple site in Habiganj

The High Court has ordered the eviction of the illegal constructions occupying the site of Sri Sri Gopal Jiur Akhara (temple and crematorium) of Lukra village in Sadar Upazila of Habiganj and Vaishnab Akhara (temple and crematorium) of Ritchie village in Sadar Upazila of Habiganj.

Habiganj District Commissioner and concerned officials have been asked to implement this order. And the plaintiff party has been asked to submit a report to the court within 15 days confirming whether the illegal construction has been evicted or not.

Justice Mustafa Zaman Islam and Justice Md. The High Court bench consisting of Atabullah gave this order along with the rule.

The court sought to know why the failure of the defendants to restore the temple and cremation ground should not be declared illegal and without legal authority. Within four weeks, the Secretary of the Land Ministry has been asked to respond to the rule. Lawyers Mahbubur Rahman and Tipu Sultan heard the writ in court.

The order was confirmed by lawyer Tipu Sultan. He said, 'Habiganj Sadar Upazila's hundred-year-old traditional temple and crematorium have been illegally occupied by 16 persons for a long time.

Among them, several persons including members of Zaheer Mia have illegally occupied the site of Sri Sri Gopal Jiur Akhara (temple and crematorium) of Lukra village in Sadar Upazila of Habiganj. And several persons including Noor Mohammad of that area have forcibly occupied the site of Vaishnab Akhara (temple and crematorium) of Ritchie village in Sadar Upazila of Habiganj.

SA Paper Khatian No. 1 of temple and cremation site, 266 dags of 34 hundredths of temple land, and 262 dags of cremation land of 70 hundredths of land. which are also recorded in the new survey. But all these have so far not been done in the name of any person which is recorded in Khatian No.1.

At present, despite being the legal owner of the land of the temple and crematorium, Noor Mohammad has actually built many shops on the land of the temple and crematorium and rented it out to various businessmen. Apart from this, he is living with his family by building a house on the remaining land.

Similarly, the space of Sri Sri Gopal Jiur Akhara is being illegally occupied by several persons including members of Zaheer Mia. Therefore, two applications were made to the Habiganj District Commissioner demanding to restore the places of those two temples and crematoriums and resume the worship, worship and cremation activities of Sanatan Dharma Bellambi. However, as he did not settle the application and take the necessary measures, a writ was filed in the High Court for its remedy.

Sumantra Das Gupta, general secretary of Habiganj's Sri Sri Gopal Vishwambhar Jiu Thakur Association, filed the writ (Writ Petition No: 13970/2023) last month as the plaintiff.

After the hearing, the court issued a ruling ordering the eviction of the illegal structures built on the site of the two arenas (temple and crematorium). Besides, it has been asked to submit a report to the court within 15 days regarding the implementation of the order.
